Does an attorney have to identify themselves as an attorney when doing business?

Our landlord is essentially shaking us down for an obscure provision in our lease that we renewed in January. We would have moved had we known he was going to demand $20k within 10 days as soon as we signed the lease.

I also just found out that the landlord is an attorney, but he did not say he was an attorney, the fact that he is an attorney is not on his business card and his name does not have a JD or Esq. after it in his email signature. He has an active license with the California State Bar. Didn’t he have to identify himself as an attorney at some point prior to signing the lease? Isn’t he supposed to present himself as an attorney to others?

Any help would be appreciated.

Rent may be adjusted in March and September each year. Each Roommate shall save these receipts until one of the following events occurs: (1) the landlord returns the security deposit without deduction or claim for any rent owed, (2) a settlement regarding unpaid rent is made between the landlord and all of the Roommates, or (3) a claim for unpaid rent is resolved in court. If the landlord claims that rent is late, Roommates shall provide proof of payment to any other Roommate upon request.

Each Roommate is liable for any damages resulting from a failure to pay rent or failure to provide proof of payment and shall indemnify the other Roommates for any damages they sustain due to her breach of this Agreement. Damages include, but aren’t limited to, late fees, interest, the landlord’s attorney fees, and court costs. If the Roommates are evicted, damages also include the moving expenses of the non-breaching Roommates and their costs of a new tenancy, including rent for the remainder of the lease period.

Even if a Roommate vacates the premises, she shall continue to pay her full rent until the lease expires or she is released in writing by all of the other Roommates.

what is the legal time frame I have to give in NYS for someone w/ children to evict?

This tenant is a piece of work. I am new to the whole renting out process and is only doing it because I need to pay the mortgage one way or another. Its a mess my parents left my husband and I with. Anyhow, I asked and was advised that since this girl has been giving me one excuse after the next and only her first month in the house she is late on rent (16 days now but she thinks its only tech 10 days as if that makes a diff) and doesnt look like she is planning on paying, that I can serve her with an eviction notice. I looked up a form on line and and used it and gave her 3 day to pay or leave clock starting today. She actually has the guts to txt me today… she said my notice was illegal , renters righst ppl with kids have 30 days to evict and she wants her security deposit back and I will be hearing from her attorney because she wants to go to court.. I said NP, plz have ur attorney call me today .. so now she will cost me $500 because I have to hire an attorney to evict her when I know if she cant afford to pay the rent she cant get an attorney … I would be so embaressed if I were her I cant believe she actually told me that .. I cant believe there are ppl out there like that . This place is costing me more than when it was empty. Is this true about ppl with children ? and also I am really not doing this to be mean , but I am behind on bills because I was depending on that rent money and didnt budget for things otherwise, and I cant have someone living there for free … so how long would this process normally take, while I continue providing a place for her to live and heating it up for her?

What happens if I move out before my court date for an unlawful detainer?

I was served an unlawful detainer complaint. I filed an answer to defend my case. I have not received a court date yet but should shortly. I found an apartment that is reasonable and plan on moving out. Do I need to notify the court once I turn over possession? Will the case be dropped? Also, I plan on paying any rent owed during my stay. Should I hold on to any money and make arrangements to pay the attorney representing the Landlord?

Can an old landlord go after me for rent after a 30 day notice has been submitted?

I had a lease with a particular (shady) Los Angeles Management Co. from October 23, 2005 to October 23, 2006. Due to irreconcilable differences with my former (flaky and overall manipulative) roommate, I moved out on November 25, 2006. I sent them the notice to vacate on October 8, and rent was paid in full. When I later called to confirm its receipt, I was given the complete runaround. (I have copies of the letter and lease) After discussing the issue with an attorney, I was informed that once I move out I was no longer liable for rent on the apartment. I then proceeding with moving out. About three months later I got a call from the manager informing me that the rent was consistently being turned in late. Essentially, they are trying to go after me for rent on an apartment I no longer live in. I informed them that legally that it was not my responsibility and that they needed to contact the old roommate. They are continuing to contact me regarding this. What should I do?

My ex signed a form to take me off of our apt lease. He was evicted, and it is now a judgement on MY credit!?

My ex signed the apt form to remove me from our apt lease, and 4 months later he was evicted. I had already moved out, and currently have my own apt (I have paid on time for 8 months now). I was never contacted or served with an eviction notice or court information. I happened to check my credit report, and saw the judgement on my credit. I contacted the apt office/manager to find out why I was added to the judgement, even though I was no longer a tenant. I was told that my info would not be sent to collections for owing this amount but that it will reflect on my credit/records. How do I remove the judgement (which I had no fault in & was never told of any court proceedings) from my records? My score has gone down!!
