Does an attorney have to identify themselves as an attorney when doing business?

Our landlord is essentially shaking us down for an obscure provision in our lease that we renewed in January. We would have moved had we known he was going to demand $20k within 10 days as soon as we signed the lease.

I also just found out that the landlord is an attorney, but he did not say he was an attorney, the fact that he is an attorney is not on his business card and his name does not have a JD or Esq. after it in his email signature. He has an active license with the California State Bar. Didn’t he have to identify himself as an attorney at some point prior to signing the lease? Isn’t he supposed to present himself as an attorney to others?

Any help would be appreciated.

1. Purpose of this Agreement. 2. Choice of Law and Forum. This Agreement shall be governed by the laws of the City of Seminole and rules of Seminole Oaks Condo Association. All legal actions brought to enforce this contract shall be brought in the courts of Pinellas County, Florida.

3. Incorporation of the Association. All Roommates shall comply with the Association. Any breach of the Association or Lease Agreement by a Roommate is also a breach of this Roommate Agreement. Where there is a conflict between these Agreements and the Association, the terms of the Association shall have precedence.

Rent may be adjusted in March and September each year. If the total amount of rent changes, each Roommates will be given at least one month notice of change in terms and rent shall be apportioned among Roommates the following month. If no such action is taken than this Roommate Agreement and Lease Agreement is renewed automatically for six months until such notice is given.

Full payment shall be paid by personal check, certified check, cashier’s check, money order, or cash at least _____ days before the rent is due. A receipt to any Roommate that requests one shall be granted at time of payment. Upon any Roommate’s second late payment, her rent shall be accelerated by $25.00 and she shall immediately pay the full amount of rent for the remainder of the lease term.

Each Roommate shall pay her rent on time and shall pay in a manner that will provide her with proof of payment such as a receipt or a cancelled personal check. To be valid, the proof of payment shall indicate the name of the payee, the amount paid, and the date received. Each Roommate shall save these receipts until one of the following events occurs: (1) the landlord returns the security deposit without deduction or claim for any rent owed, (2) a settlement regarding unpaid rent is made between the landlord and all of the Roommates, or (3) a claim for unpaid rent is resolved in court. If the landlord claims that rent is late, Roommates shall provide proof of payment to any other Roommate upon request.

Each Roommate is liable for any damages resulting from a failure to pay rent or failure to provide proof of payment and shall indemnify the other Roommates for any damages they sustain due to her breach of this Agreement. Damages include, but aren’t limited to, late fees, interest, the landlord’s attorney fees, and court costs. If the Roommates are evicted, damages also include the moving expenses of the non-breaching Roommates and their costs of a new tenancy, including rent for the remainder of the lease period.

Even if a Roommate vacates the premises, she shall continue to pay her full rent until the lease expires or she is released in writing by all of the other Roommates.

5. Utilities. The Roommates agree to pay those utilities not included in the rent according to the following amounts or shares:

I’m looking for a roommate online and my friend told me because I do not know these people and they will be living in my condo that I should locate the most detailed roommate agreement that I could find to protect myself.

What happens if I move out before my court date for an unlawful detainer?

I was served an unlawful detainer complaint. I filed an answer to defend my case. I have not received a court date yet but should shortly. I found an apartment that is reasonable and plan on moving out. Do I need to notify the court once I turn over possession? Will the case be dropped? Also, I plan on paying any rent owed during my stay. Should I hold on to any money and make arrangements to pay the attorney representing the Landlord?

Can an old landlord go after me for rent after a 30 day notice has been submitted?

I had a lease with a particular (shady) Los Angeles Management Co. from October 23, 2005 to October 23, 2006. Due to irreconcilable differences with my former (flaky and overall manipulative) roommate, I moved out on November 25, 2006. I sent them the notice to vacate on October 8, and rent was paid in full. When I later called to confirm its receipt, I was given the complete runaround. (I have copies of the letter and lease) After discussing the issue with an attorney, I was informed that once I move out I was no longer liable for rent on the apartment. I then proceeding with moving out. About three months later I got a call from the manager informing me that the rent was consistently being turned in late. Essentially, they are trying to go after me for rent on an apartment I no longer live in. I informed them that legally that it was not my responsibility and that they needed to contact the old roommate. They are continuing to contact me regarding this. What should I do?

I don’t hate Israel, but I do love the truth about all things in order to form an educated view of a matter. I often see people blaming the entire population of Palestine for the acts of terrorists yet I am certain that these same individuals are clueless as to the Israeli terrorists group(s).
In defense of Israel’s terrorists group, jack (below) states: “The difference between Freedom Fighters and Terrorists is that Freedom Fighters don’t go killing their own people or attacking others on foreign soil.”

Jack apparently isn’t aware that Lehi was listed as a terrorist organization ALSO jack ‘s own statement (copied above) would implie that the PLO and Hesbolah are Freedom Fighters as they do not attack their own people nor on foreign soil as Israel settlements is on Palestine soil. tenant /landlord issues?

hello i need help i was a victim of an illegal lock out and i went to court and they adjourned due to the fact the landlord’s attorney wasn’t present . i need a lawyer that could help me with my situation

Have renter from hell and also a felon who lies.?

I have issued a 20 day eviction but the renters are still there. He has 2 felony charges against him for level 4 Domestic Abuse, denies both. Is sueing me in Small Claims for $5,000. Manufactured the reasons as follows -Misrepresenting rental property,- failure to repair- and harrassment. This yahoo has changed the locks w/o giveing me a key. Has never sent info. to me regarding the complaints. Rent has been paid up until last month and now this month…Today 3/3/09.
The District Court in Skagit Co, WA.state has 7 official forms to file, w/ a charge of $150 to do this. I depend on this rent for my livelihood, and w/ 2 months w/o rent and a bogus small claims charge, I am terrifyed.
This guy used as an excuse for no credit history when he applied to rent the home that he had been out of the country for 8yrs.. Found out he was in and out of prison on various drug violations during that time! Since he is a felon, he is not entitled to free legal representation and has hired a lawyer and thinks I am going to be the wallet for this attorney.
Please help me w/ ideas as to getting rid of this bad guy other than me paying an attorney to do the job or finding sumi wrestlers. (My 1st choice!)

I need to find a civil attorney in Tucson, Az USA?

I have a Landlord/tenant dispute (I am tenant) and I need to find a lawyer in the Tucson area. I make too much to qualify for legal aid, but the dispute is for little money, so I would like someone who would work pro bono; perhaps to get some trial practice. Anyone know someone to call? I have checked the internet and phone books already. This would have to be from someone’s personal experience, or maybe someone reading this IS that person?

What should I do with my borderline mother?

I have a love/hate/hate relationship with my mother. She abused me as a child, hated me for the fact that I missed my father (who left her), blamed me for her having not gone back to college, and has done so much to try to keep me back in life. She’s succeeded a lot, and I’m growing weary of fighting her. I honestly wish that she were either dead or far enough away from me where she wouldn’t visit. She’s too selfish to get on a plane unless someone pays for it.

The woman stripped me and beat me, slapped me if I looked like I didn’t agree with her words/actions, called me names, refused to sign my FAFSA forms when it was time for me to go to college (she was afraid of her identity getting stolen…but she has tons of credit cards). She took me to a foreign country and got jealous when I learned the language and was able to get around and have fun…when she could not. She had married a man she’d only known for months, and rather than admit to her fault, she lied to my family about me. She ruined my reputation with them. I had a stroke two years ago, and she refused to tell my family I was sick. She told her sisters I was faking. How do you fake your way into the ICU?

The woman is always around willing to help until I really need her, and then she’s struggling. Right now I’m facing eviction, and she’s complaining about how she can’t get her multiple houses rented. My fiancee and I juggle medical needs with bills, struggle to put food in our fridge, and she drives a Chrysler 300.

I just started working again, and asked my mom to help me (stupid STUPID me) with half of daycare for a month. $75 a week, so we’d have a little bit left over from my serving tips (I went on bedrest to have my son just before the economy took a nosedive). She’s struggling in her house with no mortgage, fridge full of food, and paid off Chrysler.

Every time I try to get on my feet, she does whatever she can to make it difficult for me. For now, I’m just gonna have to break even with this job. They want to train me for management, but I’m just paying for daycare now. No extra income. I hope it doesn’t take long.

I am a smart, hardworking individual. Before I got sick I was working two full-time jobs and going to school full-time with a 3.7 GPA. I’m NOT a slacker. I work as hard as I can, but sometimes I can’t do it all. Sometimes my family can’t do it all. If it weren’t for my fiancee’s parents I don’t know where we’d be. And they’re far less wealthy than my mom. I feel like for her “helping” is just something she can use to make herself look good. It doesn’t come from her heart. She keeps saying that she’s always taught me right and been there for me, but that’s far from the truth. Everything I’ve learned on my own she claims she’s taught me. Every success I’ve had she takes credit for. And every time I need her, she makes me feel like a freeloader.

My brother says my mom owes me nothing. I feel she owes me love, and that’s more than just words. I told her that if she didn’t care, she should have gotten that abortion. Should I just write her off? Trying to compromise with this woman has me feeling like a dog searching for scraps from the rich man’s table.
